1. Agreement to Terms

These Terms of Service constitute a legally binding agreement between you and [Company Name] ("we", "us", or "our") concerning your access to and use of the Super WhatsApp developer console (the "Service"). By accessing the Service you agree to be bound by all of these Terms. If you disagree with any part of them, you must discontinue use immediately.

2. Intellectual Property Rights

Unless otherwise indicated, the Service — including its source code, databases, functionality, software, designs, text, and graphics — is our proprietary property. You are granted a limited licence to access and use the Service for your own internal business purposes. No part of the Service may be copied, reproduced, republished, or exploited for any commercial purpose without our express prior written permission.

3. User Registration and Responsibilities

You must register an account with a valid email address and a password, and complete two-factor authentication enrolment, to use the Service. You agree to keep your password confidential, to keep your two-factor backup codes secure, and you accept responsibility for all activity under your account and connected WhatsApp numbers. You represent that all registration information you supply is accurate and that you will comply with all applicable laws when using the Service.

4. Prohibited Activities

You may not access or use the Service for any purpose other than the one we make it available for. Prohibited activities include, without limitation:

  • sending spam, unsolicited bulk messages, or messages that violate WhatsApp's own terms of service;
  • harvesting or scraping data from the Service or from WhatsApp through the Service;
  • circumventing, disabling, or otherwise interfering with security features of the Service, including rate limits, authentication, and webhook signing;
  • using the Service to harass, abuse, defraud, or harm another person;
  • uploading or transmitting viruses or other malicious material;
  • attempting to gain unauthorized access to other accounts or to the Service's infrastructure.

We may suspend or terminate accounts engaged in prohibited activities.

5. Third-Party Services and WhatsApp

The Service is an independent product. It is not affiliated with, endorsed by, sponsored by, or in any way officially connected with WhatsApp LLC, Meta Platforms, Inc., or any of their subsidiaries. "WhatsApp" is a trademark of WhatsApp LLC. Your use of WhatsApp through the Service remains subject to WhatsApp's own terms, and you are solely responsible for ensuring that your use complies with them. Authentication is provided through Supabase; your credentials are processed subject to Supabase's terms and our Privacy Policy.

6. Service Management, Modifications and Interruptions

We reserve the right to monitor the Service for violations, to refuse or restrict access, and to modify, suspend, or discontinue all or part of the Service at any time without notice. We do not guarantee the Service will be available at all times; connectivity to WhatsApp depends on third-party infrastructure outside our control.

7. Term and Termination

These Terms remain in effect while you use the Service. We may, in our sole discretion and without notice or liability, deny access to the Service to any person, or terminate your account, including for breach of these Terms. You may stop using the Service and request account deletion at any time.

8. Disclaimer

THE SERVICE IS PROVIDED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS. YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE MAKE NO WARRANTY THAT THE SERVICE, INCLUDING MESSAGE DELIVERY THROUGH WHATSAPP, WILL BE UNINTERRUPTED, TIMELY, OR ERROR-FREE.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS OR DATA, ARISING FROM YOUR USE OF THE SERVICE. OUR AGGREGATE LIABILITY WILL AT ALL TIMES BE LIMITED TO THE AMOUNT PAID, IF ANY, BY YOU TO US FOR THE SERVICE DURING THE SIX (6) MONTHS PRIOR TO ANY CAUSE OF ACTION ARISING. You agree to indemnify and hold us harmless from any claim arising out of your use of the Service or breach of these Terms.

10. User Data

We maintain the data you transmit to the Service for the purpose of operating it, as described in the Privacy Policy. You are solely responsible for the content of messages you send through your connected WhatsApp numbers.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of [Governing Jurisdiction], without regard to conflict-of-law principles. The parties will attempt to resolve any dispute informally for thirty (30) days before initiating formal proceedings.
